Delhi govt powers can`t be overruled by LG: Subramanium

Senior lawmaker G Subramanium has reacted to the ongoing tussle between Delhi government and Lt. Governor Najeeb Jung over appointment of Shakuntala Gamlin as Chief secy.

Subramanium said, ” It is constitutionally unviable for LG to act dehors (without agreement of) the aid & advice of council of ministers:

He also added that, “Exercise of powers by Delhi government cant be overruled by LG as this violates Constitutional Scheme.”

Subramanium also stated that all this would fall foul of basic structure of Constitution as it undermines basic features of democracy & the cabinet form of government.

Gopal Subramanium`s legal opinion to Delhi government comes at a time when other constitutional experts like Indira Jaising and Rajeev Dhawan took the government`s side and termed LG`s actions unconstitutional.
