Apple`s legal win over Samsung reversed partially


 The Us Appeals court, in the latest twist in the Intellectual property battle between Apple and Samsung, asked for an update on the damages that were awarded sans the Trade dress claim by Apple.

This implies that up to 40 per cent of the $930 million verdict won by Apple must be reconsidered, amounting to $380 million. Apple prevailed on the most central issue that a range of Samsung devices infringed upon several of Apple’s patented inventions for the iPhone but ruled against Apple’s “trade dress” claims that Samsung had copied the iPhone to trade on the public recognition associated with its distinctive look and design.

The court said that the trade dress claims of “rectangular product with four evenly rounded corners,” “a flat, clear surface covering the front of the product” and screen icons, were based on functional elements of the phone and were not entitled to legal protection.
