Supreme Court criticises Madras HC judge in a rape case

Supreme Court on Wednesday criticised the Madras High Court’s judge’s decision to advise a rape victim to go for a settlement with her tormentor.

The court described this attitude as “a spectacular error” which is “against the dignity of women.”

Madras High Court on Thursday last week had granted bail to a rape accused before referring the case for mediation between the minor rape victim and the accused.

Invoking religion, Justice D Devadass said,” even in Islam, Hinduism and Christianity, there are instances of solving the disputes in a non-belligerent manner. The result of it is very good because there is ‘no victor, no vanquished’.”

The apex court’s comments today were made in the context of another rape case from Madhya Pradesh.
