Election Commission withdraws notice against Rahul Gandhi for TV interview

The Election Commission has withdrawn its notice to the Congress President Rahul Gandhi for giving interviews to TV channels after the campaigning for the Gujarat assembly polls had ended.

The Congress had launched an unprecedented attack against the EC accusing the Chief Election Commissioner Achal Kumar Joti of working as a personal secretary to Prime Minister Narendra Modi.

The party’s chief spokesperson, Randeep Surjewal, had said, “The Chief Election Commissioner (AK Joti), who was Chief Secretary to Modi (when he was Chief Minister of Gujarat), is still acting as the Chief Secretary to Modiji. This is shameful for the Election Commission.”




Meanwhile, the EC directed to constitute a Committee to examine the provisions of Section 126 of Representation of the People Act, 1951.

The committee will have representation from ECI, I&B Ministry, Law & Justice, Electronics & It Ministry with representatives of NBA, PCI, among others to examine these provisions in the prevailing context of communication technologies, reported Times of India.

The EC had asked Rahul to reply by 5 PM on 18 December over his interview to TV channels. The poll body also asked him to ‘explain why action should not be taken against you for violating provisions of Model Code of Conduct, failing which Commission will decide matter without any further reference to you.”

B Swain, Chief Electoral Officer, Gujarat, had said, “We have been directed by the EC to take actions by filing FIR against violation of 126 (1) (b) of Representation of People Act 1951 in the areas going to polls tomorrow and we are working on it.”

Rahul had given interviews to several TV channels including ABP News after the campaigning ended for the second phase.

The EC had also asked action to be taken against the TV channels, which aired Rahul’s interview.
